Will your training protect your company from employee lawsuits? A federal judge says ours will.
Comply America's training ordered by federal judge in class action discrimination suit.
The National Law Journal article (referenced below) profiles a case that has been on National Public Radio and previously reported in the Chicago Tribune. The CLC (Chicago Lawyers Committee of Civil Rights Under the Law Inc.), a prominent public interest group, prosecuted the sexual harassment class action case. The CLC was provided access to our training program and they were impressed with the training program and made the training part of the court order. The injunctive relief section of the Final Order is found in section 9 and our specific role is described in subsection 9b. (See below)
The article title is "NPR : Morning Edition for Thursday, May 23, 2002 : Temps Settlement" and can be found at http://search1.npr.org/opt/collections/torched/me/data_me/seg_143804.htm NLJ article; National Law Journal June 10, 2002 SECTION: NEWS; Vol. 24; No. 39; Pg. A17 LENGTH: 799 words HEADLINE: "Temps settle harassment case Demanding sexual favors."
This is a lead case involving the sexual harassment of temporary employees and the critical need to train temporary workers on company policies for companies to avoid litigation. The article concludes " the lesson for employers from such cases is that communication is important. To avoid liability, employers need to be sure that temporary workers are aware of internal policies and procedures and know whom to talk to in the event of problems."
On-site training will never address this issue due to the transitory nature of temporary employees. The Comply America on-line training program will provide substantial legal protection to your company. As you know our training program has been reviewed and endorsed by The Practicing Law Institute so it is of little surprise that a recognized public interest group such as the CLC endorses the program. The CLC demonstrated their approval by requiring Comply America training as a condition of settlement, in this highly publicized case.
The Final Order states, in section 9b:
" At defendant's expense and on Defendant's company time, all employees of Defendant (whether temporary or permanent, and whether management level or staff), shall complete the customized, computer-based training regarding harassment in the workplace in the format developed by Comply America, a sample of which is viewable at www.complyamerica.com...."
The ease of use and substantial legal benefits of our training programs will make this training indispensable to an effective risk management program.
